Access to information in Belgium

Abstract

This paper covers the Belgian legislation related to access to information. Who had access? How to make a request? Who has to grant access? Why was there an evolution in the coverage? It will deal with case law and decisions of specific bos and large infrastructure projects. This creates a lot of tension dies of appeal. Under what conditions access is granted? What is the procedure? What are the exceptions? What is the relation with our constitution and what about judicial protection? What about partial disclosure? What’s the difference between the duty on active and passive information providing? The research will also use some real life cases to address the issues in the paper. As we see in practice this legislation is oftentimes used in relation to (the procurement of) PPP
