Die Vollkostendeckung der österreichischen Gerichte führt einerseits zu einer Entlastung des steuerfinanzierten Staatshaushaltes und ermöglicht somit die Eindämmung der Abgabenlast. Andererseits bringt die hohe finanzielle Eigenständigkeit des österreichischen Justizressorts das Risiko mit sich, dass das Recht auf Zugang zur Justiz wegen hoher erfahrenskosten nicht ohne Weiteres gewährleistet werden kann. Dieser Beitrag macht klar, was die Fallstudie Österreich auszeichnet und zeigt, dass ein hoher Eigendeckungsgrad sich mit der Gewährleistung des Justizzugangs vereinbaren lässt. Der Zugang zur Justiz ist für alle Einwohner Österreichs gewährleistet durch: (I) Querfinanzierung des Justizressorts, (II) Steigerung der Leistungsfähigkeit und Senkung der Kosten durch den Einsatz von Informations- und Kommunikationstechnologien und (III) Verfahrenshilfesystem. Die österreichische Justiz kann vielen
europäischen Regierungen in Bezug auf deren Einsparungspolitik, sowie auch in neuen Bereichen wie e-Government als Vorbild dienen. The Austrian Justice system is characterized by the highest cost coverage ratio in Europe. On the one hand, the financial self-sufficiency of public services is helpful in lowering the burden on the Austrian state budget and the tax payers. On the other hand, it may endanger the equal access to justice for low-income persons due to high court fees. Analyzing the Austrian case, this paper demonstrates how a self-supporting justice system with a high cost coverage ratio can guarantee equal access to justice to its citizens. The Austrian Justice system is cross-subsidized by retributions related to non-litigious company register and land register cases. More importantly, the increased performance of the court system which is due to, among others, investments in ICT has lowered the average cost of a trial. Finally, Austrian citizens are entitled to legal assistance. Clearly, in the area of Justice, Austria sets an example to its European partners for combining healthy public finances, social policy and e-government. |
