dc.description.abstractThe recent judgment of the Italian Council of State emphasises the mandatory inclusion of the minimum environmental criteria (MEC) in the public tender's definition of the subject matter. The argumentative path regarding the relevance of the MEC appears appreciable in this case as it resulted not only in the relaunch of the tender but also in the declaration of the ineffectiveness of the public contract stipulated in the meantime.-
